Dropshipping Policy

This Dropshipping Policy governs Brand Owners who use a dropshipping fulfillment model on the platform operated by Legalize Freedom LLC, a Delaware limited liability company doing business as "PlatformDTC" ("PlatformDTC," "we," "us"). It supplements our Terms & Conditions, Acceptable Use Policy, Shipping & Delivery Policy, and Refund Policy. Capitalized terms not defined here have the meaning given in our Terms & Conditions.
By operating a dropshipping store on PlatformDTC, you agree to this Policy. Failure to comply may result in fund holds, suspension, or termination, and may be reported to payment processors and authorities.
1. What Dropshipping Means Here
"Dropshipping" is a fulfillment model in which a Brand Owner sells products to Customers but does not hold inventory; instead, orders are forwarded to a third-party Supplier (manufacturer, wholesaler, or fulfillment partner) who ships the product directly to the Customer.
The Brand Owner is the seller and merchant of record for every order. PlatformDTC is a software platform; it does not source, own, warehouse, inspect, fulfill, or ship dropshipped products, and is not the seller of those products.
2. Brand Owner Responsibilities
As a dropshipping Brand Owner, you are solely responsible for:
- The accuracy of your storefront, product listings, pricing, and claims;
- Vetting and managing your Suppliers and the quality, safety, and legality of products;
- Fulfillment, delivery, customer service, returns, refunds, and dispute handling;
- Compliance with all applicable laws (consumer-protection, advertising, product-safety, tax, customs, import/export, and intellectual-property laws); and
- Compliance with the rules of any payment processor you use through the platform.
3. Honest Delivery Times & FTC Prompt-Delivery Compliance
Long or undisclosed shipping times are the leading cause of "item not received" disputes and account termination. You must:
- Disclose realistic delivery windows clearly at the point of sale (on the product page and at checkout), including any extended international transit times — not buried in a policy link.
- Comply with the FTC Mail, Internet, or Telephone Order Merchandise Rule ("Prompt Delivery Rule"): have a reasonable basis to ship within your stated time frame, or, if none is stated, within 30 days of receiving a properly completed order.
- If you cannot ship on time, notify the Customer, obtain consent to the delay, or refund the unshipped portion, as the Rule requires. Non-compliance can carry significant civil penalties per violation (tens of thousands of dollars, adjusted annually for inflation) and is grounds for removal from the platform.
- Never advertise delivery times you cannot meet, and never list "in stock / fast shipping" for goods shipping from distant Suppliers on long timelines.
4. Supplier Vetting, Product Safety & Compliance
You must:
- Use legitimate, identifiable Suppliers and maintain the ability to honor orders, returns, and refunds.
- Sell only products that are safe, legal, and accurately described, and that comply with applicable product-safety, labeling, and regulatory requirements.
- Not sell counterfeit, trademark- or copyright-infringing, recalled, hazardous, or otherwise prohibited goods. The prohibited and restricted categories in our Acceptable Use Policy apply in full to dropshipped products.
- Ensure imported goods clear customs lawfully; the Customer is the importer of record for any duties, taxes, or import fees, and this must be disclosed before purchase.
5. Accurate Listings — No Deceptive Practices
You must not:
- Use stolen, misleading, or materially altered product images or descriptions;
- Make false or unsubstantiated performance, health, or origin claims;
- Use fake reviews, fake scarcity/countdown timers, fabricated "original" prices, or other deceptive urgency or pricing tactics; or
- Misrepresent where a product ships from or how long it will take.
6. Returns, Refunds & Cancellations
- You must offer a fair, workable returns and refunds process consistent with our Refund Policy and applicable law, even when products ship from overseas Suppliers.
- You must honor statutory rights (including EU/UK rights of withdrawal where applicable) and process approved refunds promptly.
- A "no refunds" policy that conflicts with consumer-protection law or processor rules is not permitted.
7. Customer Service Standards
- Provide a monitored support channel and respond to Customer inquiries promptly (we recommend within 1–2 business days).
- Provide order tracking and proactive updates, especially for long-transit orders.
8. Payments, Chargebacks & Reserves
- You must keep your dispute/chargeback rate below 0.75% (target ~0.5%). Excessive disputes can trigger reserves, payout pauses, monitoring programs, or termination by the payment processor and by PlatformDTC.
- Reduce the expectation gap: clear billing descriptors, honest delivery windows, tracking on every order, responsive support, and easy refunds.
- Payment processors may apply rolling reserves or holds (commonly 30–90 days) to higher-risk dropshipping accounts, and dispute windows can be long (e.g., PayPal allows 180 days for "item not received"). You are responsible for cooperating with and responding to all disputes.
- You must comply with the rules of Stripe, PayPal, and any other processor used through the platform. Certain regions and categories may be ineligible at the processor's discretion.
9. Monitoring & Enforcement
PlatformDTC may, at its discretion and without obligation:
- Review storefronts, listings, Suppliers, delivery times, and dispute/refund rates;
- Require corrective action or additional verification;
- Place holds on funds, limit features, suspend, or terminate stores that violate this Policy or create undue risk; and
- Report unlawful activity to payment processors, card networks, and authorities.
Rejection or termination for cause may be permanent.
10. Indemnification & Liability
The Brand Owner is responsible and liable for its products and orders, including product-liability, safety, IP, and consumer-protection claims, and agrees to indemnify and hold PlatformDTC harmless from any claims, losses, fines, or penalties arising from its dropshipping activities, as further set out in our Terms & Conditions.
11. Changes to This Policy
We may update this Policy from time to time. Material changes will be posted here with an updated "Last Updated" date. Continued use of the platform after changes take effect constitutes acceptance.
