Acceptable Use Policy

This Acceptable Use Policy ("AUP") describes activities that are prohibited on the platform operated by Legalize Freedom LLC, a Delaware limited liability company doing business as "PlatformDTC" ("PlatformDTC", "we", "us"). This AUP supplements our Terms of Service and applies to all Users, including Brand Owners, Customers, and visitors.
Violation of this AUP may result in immediate account suspension or termination, fund holds, refund of Customer transactions, and reporting to law enforcement.
1. Why This Policy Exists
PlatformDTC powers commerce and payment processing for thousands of DTC brands. To protect Customers, Brand Owners, Stripe (our payment processor), and the integrity of the financial system, we maintain strict use standards consistent with:
- U.S. federal and state laws
- Stripe's Restricted Businesses list
- Visa, Mastercard, Amex card network rules
- OFAC, FinCEN, and equivalent international regulations
- GDPR, CCPA, and applicable privacy laws
2. Prohibited Businesses and Activities
You may NOT use PlatformDTC for the following:
2.1 Financial Crimes
- Money laundering, structuring, or transaction layering
- Terrorist financing
- Sanctions evasion
- Tax evasion
- Unlicensed money services (MSB), money transmission, currency exchange
- Cryptocurrency exchanges, ICOs, NFT marketplaces without prior written approval
2.2 Fraud and Deception
- Fraudulent products, services, or sales practices
- Fake or misleading product claims
- Pyramid schemes, Ponzi schemes, multi-level marketing without disclosure
- "Get rich quick" schemes
- Fake reviews, paid reviews without disclosure, review manipulation
- Identity theft, phishing, impersonation
- Counterfeit goods, replicas, knock-offs
- Unauthorized resale of branded products
2.3 Illegal Goods and Services
- Illegal drugs, drug paraphernalia, controlled substances
- Cannabis, CBD, kratom, or hemp products (unless legally compliant in all jurisdictions AND pre-approved)
- Prescription medications without proper licensing
- Tobacco, e-cigarettes, vape products (without approval and age verification)
- Alcohol sales without proper licensing and age verification
- Firearms, ammunition, weapons, explosives
- Stolen goods
- Human trafficking, prostitution, escort services
- Sale of human organs, blood, or body parts
2.4 Adult and Sensitive Content
- Pornographic or sexually explicit content
- Adult dating services
- Sex toys without age verification and proper category classification
- Content sexualizing minors (zero tolerance — will be reported to NCMEC immediately)
- Bestiality, non-consensual content, or other extreme content
2.5 Regulated Products (without pre-approval)
- Gambling, lotteries, sweepstakes, sports betting
- Securities, investment products, binary options, forex trading
- Pharmaceuticals, medical devices
- Supplements with unverified health claims
- Pseudo-pharmaceuticals (miracle cures, anti-aging, weight loss claims without FDA review)
- Health and wellness products that violate FTC/FDA guidelines
2.6 Harm to Others
- Hate speech, violence, harassment, threats
- Content promoting terrorism, extremism, or genocide
- Discrimination based on race, religion, gender, sexual orientation, disability
- Doxxing, stalking, or invasion of privacy
- Content depicting graphic violence or gore
- Self-harm promotion, dangerous "challenges"
2.7 Intellectual Property Violations
- Selling counterfeit or pirated goods
- Unauthorized use of trademarks, logos, or copyrighted material
- Sale of cracked software, unauthorized streaming, or content piracy
- Plagiarism or unattributed AI-generated content claimed as original work without disclosure
2.8 Misuse of the Service
- Reverse engineering, scraping, or unauthorized API access
- Circumventing rate limits, security, or access controls
- Uploading malware, viruses, or malicious code
- Using the Service to attack other systems (DDoS, brute force)
- Creating multiple accounts to evade bans or limits
- Sharing accounts or credentials
- Reselling the Service without authorization
- Operating bot networks or automated abuse
2.9 AI-Specific Misuse
- Generating deepfakes of real people without consent
- Creating non-consensual intimate imagery (NCII)
- Generating misinformation, fake news, or disinformation campaigns
- Producing content for political manipulation or election interference
- Mass-generating spam, fake reviews, or astroturfing content
- Generating content that violates intellectual property rights
- Using AI to facilitate fraud, scam, or social engineering
2.10 Restricted Geographies
We do not provide service to individuals or entities in:
- OFAC-sanctioned countries: Cuba, Iran, North Korea, Syria, Crimea region of Ukraine, so-called Donetsk and Luhansk People's Republics
- Any country on the OFAC Specially Designated Nationals (SDN) list
- Any region where our Service would violate applicable export, sanctions, or import laws
3. Stripe Restricted Businesses
In addition to the above, we follow Stripe's restricted business list. See full list at: https://stripe.com/legal/restricted-businesses
If your business model falls into a "restricted" category on Stripe's list, you must obtain prior written approval from PlatformDTC before processing payments.
4. Reporting Violations
If you become aware of violations of this AUP, please report to:
- General reports: abuse@platformdtc.com
- Fraud / financial crime: fraud@platformdtc.com
- Child safety / CSAM: trust-safety@platformdtc.com (also reported to NCMEC)
- IP infringement: see DMCA Policy
- Security issues: security@platformdtc.com
We investigate all reports. False or malicious reports may themselves violate this AUP.
5. Enforcement
We may, at our sole discretion:
- Issue warnings
- Require remediation actions
- Temporarily suspend account or specific features
- Permanently terminate accounts
- Hold funds, refund Customers, or reverse transactions
- Report to law enforcement, Stripe, card networks, or relevant authorities
- Cooperate fully with investigations
Enforcement decisions are at our sole discretion and are not subject to appeal in cases of serious violations (fraud, child safety, terrorism, sanctions).
6. Changes to This Policy
We may update this AUP as laws, regulations, or platform risks change. Material changes will be notified at least 14 days in advance. Continued use after changes constitutes acceptance.
